United States Bankruptcy Code
- Chapter 7 Bankruptcy
To qualify for relief under Chapter 7 of the U.S. Bankruptcy Code, the debtor may be an individual, a partnership, or a corporation or other business entity. Chapter 7 is different from other bankruptcy chapters because the debtor can eliminate most debts without paying back money to their creditors.
- Chapter 11 Bankruptcy
Chapter 11 of the U.S. Bankruptcy Code permits a business, whether a corporation or sole proprietorship, and some individuals, to restructure and repay debt under a plan of reorganization. Control of regular business operations remains with the filer, but is now under the jurisdiction of the Bankruptcy Court.
- Chapter 13 Bankruptcy
Chapter 13 of the U.S. Bankruptcy Code allows individuals with regular income to develop a plan to repay all or part of their debts over a three to five-year plan of reorganization. Chapter 13 is an alternative for individuals that exceed the income requirements for a Chapter 7. The portion of debt paid back to creditors is determined by debtor's disposable income.
Most people want to pay their bills but unexpected medical expenses, unemployment or bad luck can make it impossible to do so. Unfortunately, there are lot of misconceptions about bankruptcy and each method of debt relief has pitfalls that can cost valuable time and money. Protect your rights.
