Basic Timelines for Filing Bankruptcy
- Free phone or in-office consultation to discuss your bankruptcy case.
- Discuss bankruptcy attorney fees and costs associated with our services (payment plans available).
- Client then fills out paperwork and gets supporting documents to our office.
- Client takes a credit counseling class on line or over the phone (approx. 45 min.).
- Client comes to office to sign and review documents that will be filed with the court.
- Our office files the case and calls the client with their case number.
- The court appoints a Chapter 7 Trustee to administer your case. This Trustee will send a letter asking the client to send documents directly to them and to call their office to answer questions about the documents, and explain why they filed Chapter 7. (Really basic questions. Just tell the truth).
- Approximately 30 to 45 days after filing bankruptcy, the client and their bankruptcy attorney will appear before the Trustee for a "341 Meeting of Creditors" to answer questions similar to those asked over the phone, this time under oath. (Again just tell the truth).
- Client takes a Debtor Education class on-line or over the phone (approx. 45 min.).
- The Court mails the client and all creditors a Notice of Discharge.
- Client starts a new life "Debt Free" and begins to repair their credit score.
